Terms and Conditions

Use of Bow Chat is also subject to our Privacy Policy.

1. Use of Bow Chat

These Terms apply to Bow Chat websites, apps, APIs, panels, campaign tools, CPaaS workflows, integrations, and related services operated by Bohni Tech Private Limited, Bangalore, Karnataka, India. Separate written agreements, order forms, DPAs, or service schedules may apply to enterprise customers and will control where they conflict with these Terms.

By accessing or using Bow Chat, you agree to these Terms and our Privacy Policy. You may use Bow Chat only for lawful business communication, support, sales, workflow, and campaign purposes. You are responsible for your organization account, users, roles, credentials, integrations, connected channels, customer data, campaigns, and all activity under your workspace.

2. Customer Data and Channel Compliance

You must have all required rights, notices, consents, opt-ins, lawful basis, and authorizations before importing contacts, connecting datasources, sending campaigns, recording calls, using AI workflows, or communicating through WhatsApp, RCS, SMS, email, voice, social, or other channels.

You are responsible for honoring opt-outs, suppression lists, do-not-contact requests, provider rules, telecom rules, anti-spam rules, privacy laws, and industry requirements that apply to your messages and campaigns.

For DPDP-covered data, you are responsible for giving clear notices, collecting valid consent where required, allowing consent withdrawal, maintaining any applicable legitimate-use or customer-instruction basis, and handling Data Principal rights, grievances, correction, erasure, and nomination where you decide the purpose and means of processing.

3. Processor Terms

Where Bow Chat processes personal data on your behalf, Bow Chat acts according to your documented instructions and the applicable DPA or processor terms.

You remain responsible for determining whether your processing is lawful and for responding to end-user rights requests unless Bow Chat is independently acting as controller/Data Fiduciary.

Unless a separate written DPA, order form, or service schedule says otherwise, these Terms and the Bow Chat baseline processor terms govern Boni's processor obligations for ordinary product use.

You instruct Bow Chat to process customer data only to provide, secure, support, troubleshoot, improve, and maintain the service; comply with law; prevent misuse; and follow your lawful configuration, campaign, integration, support, and deletion instructions.

You authorize Bow Chat to use service providers and subprocessors needed to operate the service, subject to confidentiality, security, deletion, and incident-support obligations appropriate to the service. We may route Data Principal requests or grievances to you when you are the responsible controller/Data Fiduciary, and you must cooperate so they can be handled within applicable timelines.

For EEA, UK, Swiss, or other cross-border customer data, additional data processing terms, Standard Contractual Clauses, transfer addenda, or similar safeguards may apply. Bow Chat does not provide EU data residency unless a separate written agreement expressly says so.

4. Datasource Connections

If you connect a database or other datasource, you represent that you are authorized to do so and that the datasource will be used only for permitted segmentation, campaign, workflow, reporting, or enrichment purposes.

Bow Chat may require purpose capture, customer authorization, field limits, masking, audit logs, permissions, and security checks before allowing queries or exports.

You must not connect data collected without required notice, consent, opt-in, or authorization, and you must not use datasource features to infer, expose, export, or message people outside the permitted purpose.

5. AI and Automation

Bow Chat may include AI-assisted features for drafting, summarization, classification, routing, translation, enrichment, or analytics. AI outputs can be inaccurate or incomplete.

You must review outputs before using them in sensitive, regulated, legal, financial, employment, healthcare, or materially customer-impacting contexts.

6. Acceptable Use

You must not use Bow Chat to send unlawful, misleading, fraudulent, abusive, discriminatory, harmful, infringing, unsolicited, or non-compliant communications.

You must not attempt unauthorized access, bypass permissions, scrape or overload the service, introduce malware, misuse APIs, extract data outside authorized purposes, or violate another person's rights.

7. Third-Party Services

Bow Chat may depend on cloud providers, messaging platforms, communications vendors, AI providers, analytics/logging tools, support services, and customer-selected integrations.

These services may have their own terms, fees, restrictions, review requirements, data practices, rate limits, and availability constraints.

These services may process data in India, the United States, the EEA, or other countries depending on the service and configuration. Where required, Bow Chat uses customer processor terms, subprocessor disclosures, and transfer safeguards rather than representing that all data remains in one country or region.

We are not responsible for third-party outages, policy changes, account restrictions, carrier/channel filtering, message delivery failures, or actions outside Bow Chat-controlled systems.

8. Security

You must keep credentials secure, use strong authentication where available, assign least-privilege roles, promptly remove departed users, and notify us of suspected compromise.

We may suspend or restrict access to protect Bow Chat, customers, end users, providers, or third parties.

You must promptly notify us if customer data, connected channels, datasource credentials, or workspace access may have been compromised so we can assess security, breach, customer, Data Principal, or regulator notification duties.

9. Fees, Refunds, and Service Limits

Paid usage, subscription terms, channel fees, provider charges, taxes, refunds, renewals, and service-level commitments may be governed by separate order forms or product schedules.

Unless a separate written agreement says otherwise, fees are non-refundable once paid except where required by law.

10. Intellectual Property

Bow Chat software, interfaces, documentation, designs, logos, and platform materials are owned by or licensed to Bohni Tech Private Limited.

You retain rights to customer data and content, and grant us the limited rights needed to provide, secure, support, and improve the service.

11. Suspension and Termination

We may suspend or terminate access if you breach these Terms, fail to pay amounts due, create security/legal risk, violate channel/provider rules, send abusive or unlawful communications, or use Bow Chat in a way that may harm Boni, customers, end users, providers, or third parties.

After termination, data return/deletion will follow applicable law, contracts, product settings, and backup retention.

12. Disclaimers and Liability

Except where a separate written agreement says otherwise, Bow Chat is provided on an as-is and as-available basis. We do not guarantee uninterrupted availability, message delivery, channel approval, carrier acceptance, error-free AI output, or fitness for every workflow.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages.

13. Governing Law

These Terms are governed by the laws of India. Courts in Bengaluru, Karnataka, India will have jurisdiction unless a separate written agreement says otherwise.
